How Is Oswego New York Bar Assault Not A Felony [NSFW VIDEO]

Daniel J. Kidd, Roberta F. Kidd and Dustyn R. Kidd were initially charged with felony second-degree gang assault and faced up to 15 years in prison if convicted.
Oswego County District Attorney Greg Oakes reduced the charges to misdemeanors or a violation, depending on the defendant's involvement.
The fight allegedly broke out after bartender Jennie Fullington told the three customers she could no longer serve them alcohol on July 2nd, 2016. Fullington was left with a broken nose along with several other injuries. "I'm getting reconstructive surgery hopefully this year. I had a concussion with whiplash, and a laceration to my scalp that required a staple."
The charges were reduced from a felony to a misdemeanor because the victims were not seriously injured and it would be difficult to prove they were working together during the assault, according to Syracuse.com. Charges against Roberta Kidd were also reduced because prosecutors felt they couldn't prove she was involved in the attack.
Daniel Kidd and Dustyn Kidd pleaded guilty late last month to third-degree assault, a misdemeanor, and will serve one year in the Oswego County Jail for attacking Fullington and Rodriguez, and pay $8,210 restitution. Roberta Kidd will be allowed to plead guilty to second-degree harassment and could get 15 days in jail.
Oswego County District Attorney Greg Oakes told Syracuse.com, State Assemblyman Bob Oaks has drafted legislation that would have permitted a felony prosecution in this case.
Fullington says her life has changed since the incident and she doesn't feel the punishment fits the crime. "This entire situation has flipped my life upside down and the District Attorney's office has completely failed the victims."
