REESE WITHERSPOON and her husband Jim Toth were ARRESTED in Atlanta DUI and disorderly conduct.

Police saw a car weaving sometime after midnight Friday, so they pulled it over. Jim was driving, and Reese was riding shotgun. As the cops were dealing with Jim, Reese started getting impatient and agitated. One of the cops says,'She began to hang out the window and say that she did not believe that I was a real police officer.'

He says he told Reese to sit down and be quiet. Once her husband was placed under arrest, Reese got out of the car. The cop told her to get back in, but she said she was a U.S. citizen, and was allowed to, 'stand on American ground.'

So he tried to take her by the arms, but she resisted, and said,'Do you know my name?' When the cop said no, he didn't need to know her name, she replied, 'You're about to find out who I am . . . You are going to be on national news.'

At that point, she was cuffed and arrested.

As for Jim, he told police he'd only had one drink several hours earlier. But they gave him a breathalyzer test and he blew a .139, which is significantly higher than the legal limit of .08.

Reese was booked under her given name, Laura Jeanne Reese Witherspoon.

Reese and Jim were released at around 3:30 in the morning. There's a hearing today, but they'll probably just send their lawyers. Reese released a statement last night:

'I clearly had one drink too many and I am deeply embarrassed about the things I said. It was definitely a scary situation and I was frightened for my husband, but that is no excuse. I was disrespectful to the officer who was just doing his job. The words I used that night definitely do not reflect who I am. I have nothing but respect for the police and I'm very sorry for my behavior.'

Reese is in Atlanta filming a movie called 'The Good Lie.'
