If you're a football fan, you've seen the ads where you can win money playing fantasy football. FanDuel and DraftKings claim to pay out millions each week. But who's really winning? New lawsuits claim it's the employees.

4 states have filed lawsuits, accusing the sites of racketeering. Employees are said to have won millions by using insider information to gain an unfair advantage. All suits are asking for full restitution, according to NBC News.

Both companies say they've banned employees from playing on other sites.

The fantasy football sites are not considered gambling because it's based on skill rather than luck. However, the Nevada Gaming Control Board ruled Daily Fantasy Sports, "constitute gambling under Nevada law" and are illegal without a state license.

Nevada regulators ordered the sites shut down to Nevada residents this week.

Daniel Wallach, a sports law expert tells NBC Sports, “Fantasy is a form of gambling that should be licensed just like sports betting, just like any other form of gambling."

FanDuel and DraftKings still operate in New York but the Attorney General is investigating and wants information on all employees from both sites.

Massachusetts, Louisiana, Illinois and New York have filed the lawsuits claiming federal fraud law violations.
