Big Frog’s $10,000 Bathroom Makeover Contest Rules

OFFICIAL CONTEST RULES 

Contest Name:  BIG FROG’S $10,000 BATHROOM MAKEOVER (the “Contest”) 

Contest Run Dates:  March 23-May 3, 2026

Townsquare Media, Inc., WFRG-FM, and affiliated companies (together, the "Company" or “Contest Organizer”), will conduct the Contest substantially as described in these rules 

By participating in this Contest, you agree as follows: 

1. Eligibility:   

The Contest is open to legal residents age 18 or older who are homeowners in Oneida, Herkimer, or Madison Counties, New York. The Contest is void where prohibited by law.  Employees, officers, and directors of New York Sash, Townsquare Media, Inc., and their parent, related, affiliated and subsidiary companies, participating vendors, media partners, advertising agencies, and employees of other radio or television stations, and members of their immediate families or households are not eligible.  For these Contest Rules, “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as in-laws or by current marriage, remarriage, adoption, co-habitation (whether or not related) or other family extension, and any other persons residing at the same household (whether or not related).  All U.S., federal, state, and local laws and regulations apply. To be eligible to win the Prize, the winner must provide proof of home ownership through legal identification and either a tax bill, mortgage payment coupon, or deed. 

1. How to Enter:   

Listeners must submit their name, address, email, phone number, and a photo of their bathroom through the official entry form titled “Big Frog 104’s $10,000 Bathroom Make-Over” on BigFrog104.com. Submissions will be accepted beginning March 23 through 11:59 p.m. on April 26, 2026. One (1) entry per household will be permitted, and no purchase is necessary to enter. 

1. Terms of Entry: 

No purchase is necessary.  All photo submissions must be received no later than 11:59 p.m. on April 26, 2026. All submissions must include name, phone number, and email.  All photo submissions must depict only the entrant’s bathroom and may not include images of people.  Submissions must not contain obscene, offensive, inappropriate, or objectionable content as determined by Contest Organizer in its sole discretion.  Photos must be of sufficient quality for display on the website.  Contest Organizer reserves the right to reject or remove any submission that does not meet these standards or is otherwise unsuitable, in its sole discretion. 

The use of any agencies or automated software to submit entries or votes will void all entries submitted by that person.  Contest Organizer reserves the right, in its sole discretion, to invalidate any votes it suspects were generated through bots, scripts, automated means, coordinated voting campaigns, or other forms of vote manipulation.  Any entry that Contest Organizer believes benefited from such manipulation may be disqualified.  Contest Organizer’s determination of vote validity shall be final and binding.  Irregularities in the entry process will be investigated by Contest Organizers and may result in disqualification.  Any decision made by Contest Organizers as a result of any such investigation shall be final. 

1. Winner Selection:    

Beginning April 27, 2026, Station will review all submissions and feature all eligible entries in a photo gallery on bigfrog104.com.  Listeners will then cast votes for their favorite photo submission. The submission with the most votes as of 11:59 p.m. May 3, 2026, will be named the contest winner. In the event of a tie, the winner will be determined by Contest Organizer in its sole discretion (e.g., by earliest submission time, random selection, or other method chosen by Contest Organizer). 

Votes will be accepted April 27, 2026, through 11:59 p.m. on May 3, 2026. One vote per person, per day will be permitted.  Odds of winning the prize depend on the number of eligible entries with respect to the Contest. 

1. Winner Notification.   

The contest winner will be contacted by Station personnel no later than 6:00 a.m. on May 4, 2026.  Winner must return the station’s call or email within 48 hours, or he/she will forfeit the prize. If Station does not hear back from the winner within 48 hours, Contest Organizer may, in its sole discretion, select the submission with the next highest vote count or choose an alternate winner by other means. 

1. Prize Descriptions: 

One (1) Grand Prize (the “Prize”) will be awarded: a $10,000 gift certificate valid for a New York Sash acrylic tub or shower with accessories, hardware, valve, fixtures, and labor costs. Gift Certificate must be accepted within 60 days of Winner notification. 

Installation must be completed by New York Sash personnel or designees.  New York Sash will obtain any required permits for installation. Any costs exceeding $10,000 shall be Winner’s responsibility.  Winner’s home must be in suitable condition for installation, including compliance with building codes and absence of mold, structural damage, or water issues. Any remediation must be performed at the Winner’s expense. If Winner’s home cannot be made suitable for installation, or if Winner fails or refuses to complete necessary remediation, the Prize shall be forfeited. Installation must be completed within six (6) months of confirmed notification. 

1. Prize Collection: 

Winner will be required to complete certain paperwork provided by Company to collect his/her prize, including, but not limited to a verification of eligibility, a liability and publicity release, and a W-9.  Winner must also complete any paperwork, agreements, or releases required by New York Sash in connection with the Prize installation.  Failure to complete paperwork required by Company or New York Sash, or to claim the Prize, constitutes forfeiture of the Prize.  Company is not responsible for and makes no representations regarding any paperwork, terms, or requirements imposed by New York Sash.  If Prize is forfeited for the above reasons, Company may, in its sole discretion, award it to an alternate winner.   

1. Prize Terms:  

Prizes are not transferable or exchangeable for any other prize or equivalent prize.  Prize(s) are subject to availability and other Contest rules.  Odds of winning a Prize depend on the number of eligible entries with respect to the Contest.  An entrant may only win one (1) prize in this contest. 

Each potential Contest Winner will be notified by phone or email of their Winner status and must return Contest Organizer’s call or email within 48 hours or risk forfeiture of the applicable Prize.  If Contest Organizer is unable to connect with entrant within such time period, Contest Organizer reserves the right to choose another Contest Winner. 

All official Contest Winners must fill out all paperwork (including verification of eligibility and a liability and publicity release) and claim his/her Prize from Contest Organizer within two (2) weeks from the date Contest Winner returns Contest Organizer’s call or email notifying entrant that he/she has won, or Contest Winner risks forfeiture of the Prize.  In Contest Organizer’s discretion, Contest Winners may be required to receive the Prize via mail, to pick up the Prize at the participating station, or to receive the Prize via another method specified by Contest Organizer.  Failure to claim the Prize within the time frame above constitutes forfeiture of the Prize.  If forfeited, the Prize may be awarded to an alternate Winner in Contest Organizers sole and absolute discretion.   

All Prize claims are subject to verification of the entrant’s eligibility and compliance with the Official Rules.  If you are deemed a Contest Winner, but found to be ineligible, you will be disqualified from the Contest, and any Prize awarded to you will be forfeited.  

1. Conclusion of Contest:  

This Contest will end with the official winner announcement on May 4, 2026. 

1. Disclaimer; Technical Issues: 

The Company is not responsible for, and disclaims all liability for, any inability of a participant to complete an entry due to equipment malfunction, internet connection issues, inadvertent disconnections, acts beyond the Company's control, or any other error, failure, or defect of any kind. The Company disclaims all liability for any delays, mis-delivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. Entries must be made as detailed herein. No photocopies or mechanical reproductions of entry forms are permitted. The Company is not responsible for human, mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Contest, and any injury or damage to entrant's or any other person's computer related to or resulting from participating in or downloading any information necessary to participate in the Contest.  

1. Conditions and Limitations: 

Company reserves the right to refuse to award a Prize to a selected Winner in the event of non-compliance with these rules. Winners are subject to a verification process to include the Winner's name, address, home phone number, work/cell phone number, social security number, and proof of home ownership.  If a Winner is disqualified, Company reserves the right to determine an alternate Winner in its sole discretion. Employees of the Company, New York Sash, and their advertising agencies, employees of other radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win.  The term "immediate family" includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as in-laws or by current or past marriage(s), remarriage(s), adoption, co-habitation (whether or not related) or other family extension, and any other persons residing at the same household (whether or not related). 

1. Publicity; Use of Personal Information: 

By participating in this Contest, all participants and Winners grant the Company a perpetual, royalty-free, worldwide license to use, reproduce, display, distribute, and create derivative works from all photos, images, and other content submitted as part of their Contest entry. Additionally, all participants and Winners grant the Company permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other Contest, participating station(s) and participating sponsor(s), and waive any claims to royalty, right, or remuneration for such use. By participating in the Contest, participants agree that the Company may disclose personal information obtained from participants to New York Sash. By entering this Contest, participants hereby grant New York Sash permission to contact them via mail, e-mail, texting and telephone call for the purpose of verifying the entry, additional product information, sales promotions now or in the future and for soliciting the sale of Home Improvement products. Message data rates may apply for texting. This authorization is effective even if you are listed on the Federal Do Not Call Registry. The authorization remains effective until a formal request is made to be placed on the Schayes, Inc. dba New York Sash Do Not Call, Do Not Text or Do Not E-mail List.

1. Release and Indemnity: 

By participating in the Contest, each participant and Winner (i) waives any and all claims of liability against the Company, its parent, related, affiliated and subsidiary companies and the employees and agents of each (collectively, the “Company Released Parties”), New York Sash, and their parent, related, affiliated and subsidiary companies and their respective employees and agents (collectively, the “Sponsor Released Parties,” together with the Company Released Parties, the “Released Parties”), for any loss, claim or cause of action or personal injury which may arise out of the conduct of, or participation in, the Contest, or from the use of any Prize including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, software applications, mobile devices, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors of any kind in the promotion or administration of the Contest or the processing of entries; or (f) injury (up to and including death) or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt or use of any Prize, including travel, and (ii) agrees to indemnify Released Parties from any and all liability resulting or arising from the Contest and does hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by Prize supplier that are sent along with the Prize. Each participant further agrees that in the event of any claim, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest, and in no event shall the Released Parties be liable for attorney's fees. Each participant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.  

1. Taxes: 

Any valuation of the Prize(s) stated above is based on available information provided to the Company, and the value of any Prize awarded to a Winner may be reported for tax purposes as required by law. Winner is solely responsible for reporting and paying any and all applicable taxes. The Company and Sponsor reserve the right to withhold and deduct taxes and charges from the Prize if and to the extent required by law.  Each Winner must provide the Company with valid identification and a valid taxpayer identification number or social security number before any Prize will be awarded.  Prizes are not transferable, redeemable for cash or exchangeable for any other Prize.  The winner will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS. 

1. Conduct and Decisions: 

By participating in the Contest, participants agree to be bound by the decisions of Company, which are final and binding. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain Winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing, or threatening behavior is prohibited. The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Company's decisions concerning such disputes shall be final and binding. If the conduct or outcome of the Contest is affected by human error, any mechanical or technical malfunctions or failures of any kind, intentional interference, or any event beyond the control of the Company, or if for any other reason the Company determines that the Contest cannot be run as planned, the Company reserves the right to terminate the Contest, or make such other decisions regarding the outcome as the Company deems appropriate. The Company may waive any of these rules in its sole discretion. ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS Contest, TELEPHONE SYSTEMS OR WEBSITE, OR UNDERMINE THE LEGITIMATE OPERATION OF THE Contest IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPATION TO THE FULLEST EXTENT PERMITTED BY LAW. 

1. Miscellaneous: 

Each Winner must submit proof of eligibility and sign the Company's release form to claim the Prize. No purchase necessary to participate or win. Void where prohibited. The Company may substitute prizes, amend the rules, or discontinue the Contest at any time. The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest. Written copies of these rules are available during normal business hours at the business offices of the Stations and by mail upon written request with a stamped, self- addressed envelope. All entries become the property of the Company and will not be returned. To be removed from our direct mail, email, or fax lists, visit the main office of the Station during regular business hours, or send a self-addressed, stamped envelope with the contest name to WFRG-FM, 9418 River Road, Marcy, NY 13403. To request the name of the winner, send a separate, self-addressed stamped envelope with the contest name to WFRG-FM, 9418 River Road, Marcy, NY 13403. Requests for winners’ lists must be received within sixty (60) days of the end of the Contest dates first listed above.  

1. Compliance with Law: 

The conduct of the Contest is governed by the applicable laws of the United States of America, which take precedence over any rule to the contrary herein.
