Both Tony Stewart and the Ward family agreed to settle their dispute over Kevin Ward's tragic death privately, but Judge Hurd who is presiding over the case rejected their requestto pass on today's hearing.

The judge said that both parties still need to attend in person at 2p today in order for him to determine if they've indeed reached an agreement and to dismiss the case, or to send it to trial next month.

Tony Stewart's car struck Kevin some four years ago now and both sides have been in contention since then about who was responsible. The news of a private settlement is encouraging asboth parties could use some peace over this tragedy and it appears that moving on for them all is near.
