iHop may soon follow in the footsteps of Toby Keith's I Love This Bar and Grill at Destiny USA. A lawsuit claims the restaurant is behind in rent and has been asked to leave.

A letter, threatening to cut power was sent to the restaurant earlier this month, according to Syracuse.com. "Please ensure any perishables and other personal property are removed from the premises" was written in a lease termination letter, that gave 5 days to "orderly withdrawal from the shopping center."

The deadline passed. The lights remained on and the restaurant remained open.

The mall took the issue to court where they are asking for $2.1 million; $24,000.00 in back rent, over $1.8 million in future rent under the 10-year lease agreement and over $300,000 of a "cash allowance" given to the franchise, according to court papers.

Back taxes started to pile up in July after iHop was only open less than a year, according to Syracuse.com.

Toby Keith's closed unexpected last May after a tax warrant was placed on the restaurant for failure to pay back taxes.
